Define, among others, rules for the conclusion of sales contracts through a store that contains the most important information on the rights of the Seller, store and consumer.

  • 1. DEFINITIONS

Business days - days from Monday to Friday, except holidays.

Account: a function of the free Shop (service provided electronically) regulated by separate regulations, thanks to which the Buyer can set up his individual Account in the Shop.

Consumer: a consumer within the meaning of the Civil Code.

Buyer: any entity that purchases from the Store.

Regulations: these regulations.

  • 3 TECHNICAL REQUIREMENTS

For the correct functioning of the Store you need:

To place an order in the Store, in addition to the requirements set out in paragraph 1, an active email account is required to register in the store and have access to purchases in the store.

  • 4 PURCHASES IN THE STORE

The prices of the goods visible in the Store are total prices of the goods, including VAT.

The Seller observes that the total price of the order consists of the price indicated in the Store: the price of the merchandise and, where appropriate, the shipping costs.

Products selected for purchase must be added to the basket in the Store.

Then, the Buyer chooses between those available in the Store: the method of delivery of the goods and the method of payment of the order, and also provides the necessary data to complete the order.

The order is placed when the content is confirmed and the Buyer accepts the Regulation.

Placing an order is the same as entering into a sales contract between the Buyer and the Seller.

The seller will provide the consumer with the confirmation of the conclusion of the contract of sale on a durable medium at the latest at the time of delivery of the goods.

The Buyer can register in the Store, that is, set up an Account in it or make purchases without registering by providing their data with each possible order.

In the Pitbull Canarias online store you will pay for purchases:

CREDIT / DEBIT CARD : We accept payments with VISA, MasterCard and Maestro.

Some banks offer Visa and MasterCard cardholders additional security measures in the form of a PIN code or password (one-time use). They show the bank and us that you are the rightful owner or

card user. If your card uses the "Verified by Visa" security standards, "MasterCard SecureCode" will be asked to enter your PIN or password. Payment will be accepted only after entering the correct code or password.

ELECTRONIC BANKING

Real-Time Internet Banking (RTOB) enables safe and easy online purchases. Payment services include Getin Bank, Idea Bank, Bank Pocztowy, Inteligo, Blik, mTransfer, Plus Bank, T-mobile Banking Services, BPSRaiffeisen, PBSCredit Agricole, Poczta Polska, ING Bank Śląski, Pekao SA, BNP Bank, iPKO, Citi Handlowy, Alior Bank, Noble Pay, Millennium, Nest Bank, Santander, SGB, iDEAL, Sofort. RTOB payments are free of additional costs.

PAYMENT ON DELIVERY

The order will be sent to you by Correros, to whom you will pay for the purchases when you collect the package.

The merchandise reservation for orders paid by bank transfer is valid for 4 days. After this period, if the transfer does not affect the account, the order will be canceled.

PAYPAL

PayPal is a type of digital wallet. PayPal stores and protects your banking information. On PayPal-enabled websites, you no longer have to provide your bank details. After selecting PayPal during verification, you will be directed to a page where you must log in to complete the transaction.

  • 6 FINISHING THE ORDER

The seller is obliged to deliver the goods without defects.

The term of the contract is indicated in the store.

In the event that the Buyer has chosen to prepay the order, the Seller will proceed with the order after payment.

In a situation where, under an order, the Buyer purchased goods with different delivery dates, the order will be processed within the time limit applicable to the goods with the longest delivery time.

The goods purchased in the Store are delivered according to the delivery method chosen by the Buyer:

  • Through the courier company or Correros

  • 7 RIGHT TO WITHDRAW THE CONTRACT

The consumer has the right to terminate the contract concluded with the Seller through the Store, subject to § 8 of the Regulation, within 30 days without giving any reason.

The term to withdraw from the contract expires 30 days from the day:

  • in which the Consumer took possession of the goods or in which a third party other than the carrier and indicated by the Consumer took possession of the goods.

  • in which the Consumer took possession of the last of the things or in which a third party, other than the carrier and indicated by the Consumer, took possession of the last of the things in the case of a contract that requires the transfer of ownership of many things that are delivered separately.

  • conclusion of the contract - in the case of a contract for the supply of digital content.

In order for the Consumer to be able to exercise the right to terminate the contract, he must inform the Seller, using the data provided in § 2 of the Regulation, about his decision to terminate the contract by means of an unequivocal statement (for example, a letter sent by post. or information sent by email).

The consumer can use the model withdrawal form at the end of the Regulation, but it is not mandatory.

To meet the deadline to withdraw from the contract, it is sufficient for the Consumer to send information on the exercise of their right to withdraw from the contract before the deadline to withdraw from the contract.

EFFECTS OF WITHDRAWAL FROM THE CONTRACT

In case of withdrawal from the contract, the Seller returns to the Consumer all payments received from him, including the costs of delivering the goods (except for additional costs arising from the delivery method chosen by the Consumer other than the cheapest usual delivery method offered by the Seller), immediately and, in any case, no later than 30 days from the day the Seller was informed about the consumer's decision to exercise the right of withdrawal.

The Seller will refund the payment using the same payment methods that the Consumer used in the original transaction, unless the Consumer agrees to a different solution, in any case the Consumer will not incur any fees in connection with this return.

The seller may withhold the refund until receipt of the merchandise or until proof of its return is provided, whichever occurs first.

The consumer bears the direct cost of returning the goods.

The consumer is only responsible for reducing the value of the goods resulting from using it in a way other than that necessary to establish the nature, characteristics and operation of the goods.

If the goods, due to their nature, cannot be returned by ordinary mail, the consumer must also bear the direct cost of returning the goods. The Seller will inform the consumer about the estimated amount of these costs in the description of the products in the Store or when placing the order.

  • 8 EXCEPTIONS TO THE RIGHT TO WITHDRAW THE CONTRACT

The right to terminate a distance contract does not correspond to the Consumer in relation to the contract:

in which the object of the service is a non-prefabricated item, manufactured in accordance with the Consumer's specifications or serving to satisfy their individual needs.

where the object of service is an item subject to rapid deterioration or has a short useful life.

in which the object of the service is an item delivered in a sealed package, which once the package is opened cannot be returned for reasons of health protection or hygiene, if the package was opened after delivery.

in which the subject of service are things that after delivery, by their nature, are inseparably connected with other things.

in which the object of the service is sound or visual recordings or computer programs delivered in a sealed package, if the package was opened after delivery.

for the distribution of newspapers, periodicals or magazines, except for subscription contracts.

in which the price or remuneration depends on the terms of the contract

  • 9 OUR RIGHT TO REJECT THE ORDER OR WITHDRAW FROM THE CONTRACT

 All orders on the Platform are subject to product availability. We expressly reserve the right not to accept an order for any reason. We also reserve the right to terminate the Contract in the following situations, by written notice, without liability for damages or costs other than reimbursement of the amount received from you in connection with the Contract canceled by us:

the product is not available / not in stock;

the billing information provided by you is incorrect or cannot be verified;

Your order is flagged by our security system as unusual or possible fraud;

acts as a reseller;

there is an error in the price displayed on the Platform; or

We were unable to deliver the order to the address you provided;

  • 10 COMPLAINTS

In the event of a defect in the merchandise, the Buyer has the option of claiming the defective merchandise under the warranty or guarantee provided in the Civil Code, provided that the warranty has been granted.

Using the guarantee, the Buyer can, under the terms and within the time limits specified in the Civil Code:

make a price reduction statement

In the event of a material defect, submit a declaration of withdrawal from the contract

Demand the replacement of the article by one free of defects.

Demand that the defect be removed

The Seller requests to submit a claim under the guarantee to the postal or electronic address indicated in § 2 of the Regulations.

If the product has received an additional warranty, information about it, as well as its conditions, is available in the product description in the Store.

Complaints about the operation of the Store should be addressed to the email address provided in § 2 of the Regulation.

The complaint will be considered by the seller within 14 days.

EXTRAJUDICIAL METHODS OF COMPLAINT EXAMINATION AND CLAIM INVESTIGATION

In the event that the complaint procedure does not yield the result expected by the Consumer, the Consumer may use, among others,:

  • free help from the municipal Consumer Ombudsman or poviat.

  • 11 PERSONAL DATA

The administrator of the personal data provided by the Buyer when using the Store is the Seller.

The Buyer's personal data is processed mainly on the basis of the contract and for its implementation, in accordance with the principles set out in the general regulation of the European Parliament and of the Council (EU) on data protection (GDPR). Detailed information on data processing by the Seller is included in the privacy policy published in the Store.

  • 12 RESERVATIONS

Buyer is prohibited from providing illegal content.

Each order placed in the Store constitutes a separate sales contract and requires separate acceptance of the Regulations. The contract is concluded on time and to fulfill the order.

The contracts concluded on the basis of these regulations are concluded in Spanish.

None of the provisions of this Regulation excludes or limits in any way the rights of the Consumer according to the law.

The provisions relating to the goods and the sales contract shall apply accordingly to the digital content and to the contract for the supply of digital content, unless the Regulation specifies these issues separately.

  • 13 PROVISIONS RELATING TO NON-CONSUMER BUYERS

The right to terminate a distance contract does not correspond to an entity other than the Consumer.

Any liability of the Seller towards the Buyer who is not a Consumer is limited to the amount of the order placed by the Buyer.

The Seller's liability under the warranty towards the Buyer who is not a Consumer is limited to one year from delivery of the goods to the Buyer.

In the event of a dispute with a Buyer who is not a Consumer, the competent court will be the competent court for the Seller's seat.

For proper operation and creation of an account, you need:

The creation of an account is completely voluntary and depends on the will of the buyer.

The account provides the Buyer with additional options, such as: viewing the history of orders placed by the Buyer in the Store, checking the order status or editing the Buyer's data.

To set up an account, fill out the appropriate form in the Store.

At the time of creating the Account, an indefinite agreement is concluded between the Buyer and the Seller with respect to the operation of the Account in the terms established in these regulations.

The Buyer may cancel the Account at any time without incurring any cost.

To unsubscribe from the Account, please send your resignation to the Seller to the email address: shop@pitbullcanarias.es, which will result in the immediate deletion of the Account and the termination of the contract regarding the maintenance of the Account. .

  • 5 COMPLAINTS

Complaints regarding the operation of the Account should be directed to the email address shop@pitbullcanarias.es.

The complaint will be considered by the seller within 14 days.

  • 7 RESERVATIONS

Buyer is prohibited from providing illegal content.

The account maintenance agreement is concluded in Polish.

In case of important reasons referred to in paragraph 4, the Seller has the right to modify these Account regulations.

The important reasons mentioned in paragraph 3 are:

  • the need to adapt the Store to the legal provisions applicable to the operation of the Store

  • improve the security of the service provided

  • change in the functionality of the Account that requires modification of the Account regulations.

The buyer will be notified of the planned change in the regulations of the Account at least 7 days before the change is implemented by an email sent to the address assigned to the Account.

In the event that the Buyer does not accept the planned change, they must inform the Seller of this by sending an appropriate message to the Seller's email address shop@pitbullcanarias.es, which will lead to the termination of the Account maintenance. in accordance with the effective date of the planned change or earlier if the buyer makes such a request.

In a situation where the Buyer does not object to the planned change until its entry into force, it is presumed that he accepts it, which does not constitute an obstacle to terminating the contract in the future.

In the event of a dispute with a Buyer who is not a Consumer, the competent court will be the competent court for the Seller's seat.

None of the provisions of this Regulation excludes or limits in any way the rights of the Consumer according to the law.

BULLETIN REGULATION

  • 1. DEFINITIONS

Newsletter: a service provided electronically without charge, through which the Customer can receive from the Service Provider previously requested messages electronically about the Store, including information on offers, promotions and news in the Store.

The Recipient of the Service may voluntarily use the Newsletter service.

To use the Newsletter service, you must have a device with the latest web browser that supports JavaScript and cookies, Internet access, and an active email account.

Emails sent as part of this service will be sent to the email address provided by the Service User when subscribing to the Newsletter.

The recipient, in order to enter into a contract and subscribe to the Newsletter service, in the first step provides in the designated place of the Store his email address to which he wishes to receive the messages sent as part of the Newsletter.   • 5 FINAL PROVISIONS

The service provider reserves the right to modify these regulations only for important reasons. An important reason is the need to change the regulations caused by the modernization of the Newsletter service or a change in the law, affecting the provision of the service by the Service Provider.

Information on the planned amendment to the regulations will be sent to the email address of the Recipient of the service provided at the time of subscribing to the Newsletter at least 7 days before the changes are introduced.

If the Recipient of the Service does not object to the planned changes until they take effect, it is assumed that he accepts them.
